TopRow – Terms and Conditions
By registering for, booking, paying for, or participating in any activity, service, or programme provided by TopRow (“TopRow”, “we”, “us”, or “our”), you confirm that you have read, understood, and agreed to be bound by these Terms and Conditions, the Website Terms and Conditions, and the Privacy Policy (together, the “Terms”).
1. Scope of Application
1.1 These Terms apply to all services, activities, programmes, and products provided by TopRow (“Activity Services”).
1.2 The sale and provision of Activity Services is expressly conditional upon the Buyer’s acceptance of these Terms.
1.3 Acceptance occurs upon registration, booking, payment, attendance, or participation in any Activity Service.
2. Booking, Ordering, and Payment
2.1 Activity Services may be booked in the following ways:
a) Via registration on a TopRow website. Email confirmation constitutes a firm booking. Activity places are allocated on a first-come, first-served basis. Payment is due at or before the first agreed session.
b) Promotional offers or discounts apply only where booking or payment is completed within the stated promotional period.
2.2 Where an Activity Service is booked for a specific date and time, TopRow does not guarantee that changes will be possible.
2.3 All prices are subject to change without notice.
3. Cancellation and Refunds
3.1 Cancellations are subject to the cancellation policy stated in the relevant service offer or on the TopRow website.
3.2 Unless otherwise stated:
a) Unpaid Activity Services may be cancelled up to two (2) weeks before the first scheduled session. No refund is due thereafter.
b) Paid Activity Services cancelled:
- More than six (6) weeks before the first session: 80% refund
- Between six (6) and two (2) weeks before the first session: 40% refund
- Less than two (2) weeks before the first session: no refund
c) Failure to attend, late arrival, or late cancellation may result in the session being charged in full.
3.3 In cases of serious illness, injury, pregnancy, or bereavement, the Buyer may request rescheduling. TopRow will use reasonable efforts to accommodate such requests and may require supporting evidence. Refunds are not guaranteed.
4. All-Weather Rowing and Environmental Conditions
4.1 Nature of the Sport
Rowing is an outdoor, water-based sport that operates year-round. Due to the nature of rowing and the climate of the United Kingdom, Activity Services are conducted in a wide range of weather conditions, including rain, wind, cold temperatures, and other challenging environmental conditions.
4.2 All-Weather Operation
Participants acknowledge and accept that TopRow sessions will proceed in most weather conditions. Adverse, uncomfortable, or inclement weather does not, in itself, constitute grounds for cancellation, rescheduling, or refund.
4.3 Unsafe or Restricted Conditions
TopRow reserves sole discretion to determine whether conditions are unsafe for on-water activity. This includes, but is not limited to:
- Lightning or electrical storms
- Red Flag conditions or navigation restrictions issued by the Port of London Authority (PLA) or other relevant authority
- Any conditions that present an unacceptable risk to participant safety
4.4 Alternative Training
Where on-water rowing is deemed unsafe or restricted, alternative land-based or gym training will be provided where reasonably possible. Such alternative training shall be considered a full and valid replacement for the scheduled rowing session.
4.5 No Refund for Weather-Related Adjustments
Weather-related changes, including substitution of on-water rowing with alternative training, do not entitle participants to refunds, credits, or rescheduling.
4.6 Acceptance
By registering for or participating in Activity Services, participants expressly acknowledge and accept that this all-weather operational approach is a fundamental and inherent aspect of rowing as a sport and of TopRow’s services.
5. Assumption of Risk and Waiver of Liability
5.1 Participation in Activity Services is entirely at the participant’s own risk. Rowing and water-based activities involve inherent risks, including but not limited to capsizing, collision, injury, cold water immersion, and drowning.
5.2 By participating, you confirm that you are able to swim competently in open water, understand the risks associated with water activities, and accept full responsibility for your own safety.
5.3 TopRow does not assess or verify swimming ability and accepts no responsibility for injury, illness, or loss arising from inability to swim or respond safely in the water.
5.4 To the fullest extent permitted by law, you waive, release, and discharge TopRow, its directors, coaches, staff, volunteers, and representatives from all liability, claims, demands, or causes of action arising out of or related to participation in Activity Services, including negligence.
5.5 Nothing in these Terms excludes or limits liability that cannot be excluded under English law.
5.6 TopRow shall not be liable for loss, theft, or damage to personal property or equipment.
5.7 Where liability cannot legally be excluded, TopRow’s total aggregate liability shall not exceed the total amount paid by the Buyer for the relevant Activity Services.
6. Participant Obligations
6.1 Participants must:
- Hold appropriate third-party insurance where required
- Be medically fit to participate
- Disclose fully and truthfully any medical conditions, injuries, medications, or other relevant information
6.2 Failure to disclose relevant information may result in exclusion from activities without refund.
6.3 Participants must:
- Follow all safety instructions and coaching guidance
- Wear appropriate clothing and equipment
- Arrive on time
- Behave responsibly, lawfully, and respectfully
6.4 Alcohol, recreational drugs, or intoxicating substances are strictly prohibited.
7. Minors
7.1 Parents or legal guardians are responsible for:
- Providing accurate and complete information
- Ensuring timely collection of minors following activities
7.2 TopRow will use reasonable efforts to notify parents or guardians of any issues affecting minors.
8. Complaints
8.1 Complaints must be submitted in writing within one (1) month of the final activity session.
8.2 TopRow will respond within fourteen (14) days or advise if further investigation is required.
8.3 Submission of a complaint does not suspend payment or contractual obligations.
9. Force Majeure
9.1 Neither party shall be liable for failure or delay in performance due to events beyond reasonable control, including but not limited to extreme weather, government action, epidemic, or industrial action.
9.2 If such events continue for more than six (6) months, either party may terminate the agreement in writing.
10. Assignment
The Buyer may not assign or transfer any rights or obligations under these Terms without the prior written consent of TopRow.
11. Relationship of the Parties
Nothing in these Terms creates a partnership, employment relationship, or agency relationship between the parties.
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with English law. The courts of England shall have exclusive jurisdiction.
13. Notices
All notices must be made in writing. Buyers must promptly notify TopRow of any changes to contact details.
14. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
15. Survival
Any provisions which by their nature are intended to survive termination shall continue in effect.
16. Amendments
These Terms may only be amended in writing and signed by an authorised representative of TopRow.
17. Entire Agreement
These Terms constitute the entire agreement between the Buyer and TopRow and supersede all prior agreements, representations, or understandings.
