TopRow – Terms and Conditions

By registering for, booking, or participating in any TopRow activity, service, or programme, you confirm that you have read, understood, and agreed to be bound by these Terms and Conditions, the Website Terms and Conditions, and the Privacy Policy (together, the “Terms”).

1. Scope

The sale and provision of any TopRow services or products (“Activity Services”) is expressly conditioned on the Buyer’s acceptance of these Terms. Acceptance occurs upon registration, booking, payment, or participation.


2. Ordering of Activity Services and Payment

Activity Services may be ordered in the following ways:

a) Via registration on a TopRow website. Confirmation by email constitutes a firm order. Activity slots are allocated on a first-come, first-served basis. Payment is due at or before the start of the first agreed Activity Service.

b) Via the webshop section of a TopRow website. A firm contract is formed once payment has been successfully processed.

c) Promotional offers or rebates are valid only if confirmation or payment is completed within the stated promotional period.

d) A contract may also be formed through acceptance of a written offer from TopRow. Written offers are valid for a maximum of 30 days and may be withdrawn in cases of unforeseen circumstances, including oversubscription.

e) In-person applications at a TopRow location form a firm contract once payment has been processed. Specific activity slots are not guaranteed, but best efforts will be made to accommodate the Buyer.

f) Where an Activity Service is booked for a specific date and time, TopRow does not guarantee that changes will be possible.

g) All prices are subject to change without notice.


3. Cancellation of Activity Services

Cancellations are subject to the cancellation policy stated in the service offer or on the website.

Unless otherwise stated:

a) Unpaid Activity Services may be cancelled up to two (2) weeks before the first scheduled session. No refund is due thereafter.

b) Paid orders cancelled:

  • More than six (6) weeks before the first session: 80% refund
  • Between six (6) and two (2) weeks before: 40% refund
  • Less than two (2) weeks before: no refund

c) No-shows or late cancellations may be charged in full.

d) In cases of serious illness, injury, pregnancy, or bereavement, Buyers may request rescheduling. TopRow will use best efforts to accommodate such requests and may require supporting evidence.


4. Assumption of Risk and Waiver of Liability

a) Participation in all Activity Services is entirely at the participant’s own risk. Rowing and water-based activities carry inherent risks, including but not limited to capsizing, collision, injury, cold water immersion, and drowning.

b) By participating, you confirm that you can swim competently in open water, understand the risks of falling into water, and accept full responsibility for your own safety.

c) TopRow does not assess or guarantee your swimming ability and accepts no responsibility for injury, illness, or loss arising from inability to swim or respond safely in the water.

d) To the fullest extent permitted by law, you waive, release, and discharge TopRow, its coaches, staff, volunteers, and representatives from all liability, claims, demands, actions, or causes of action arising out of or related to participation in Activity Services, including negligence.

e) You agree not to bring any claim or legal proceedings against TopRow in respect of injury, loss, or damage sustained during participation, except where liability cannot be excluded under English law.

f) TopRow shall not be liable for theft, loss, or damage to personal property, equipment, or materials.

g) TopRow’s total aggregate liability, where liability cannot legally be excluded, shall not exceed the total amount paid by the Buyer for the relevant Activity Services.


5. Participant Obligations

Participants must:

  • Hold appropriate third-party insurance
  • Be medically fit to participate
  • Disclose any medical conditions, injuries, medications, or other relevant information truthfully and promptly

Failure to disclose relevant information may result in exclusion from activities without refund.

Participants must:

  • Follow all safety instructions
  • Wear suitable clothing
  • Arrive on time
  • Behave responsibly and lawfully

Alcohol, recreational drugs, or intoxicating substances are strictly prohibited.


6. Minors

Parents or legal guardians are responsible for:

  • Providing accurate information
  • Ensuring safe collection after activities

TopRow will use best efforts to notify parents or guardians of any issues affecting minors.


7. Complaints

Complaints must be submitted in writing within one (1) month of the final activity session. TopRow will respond within 14 days or advise if further investigation is required.

Submitting a complaint does not suspend payment or contractual obligations.


8. Force Majeure

Neither party shall be liable for failure or delay caused by events beyond reasonable control, including but not limited to extreme weather, government action, epidemic, or industrial action.

If such events persist beyond six (6) months, either party may terminate the contract in writing.


9. Assignment

Buyers may not assign rights or obligations without written consent from TopRow.


10. Relationship of the Parties

Nothing in these Terms creates a partnership, employment relationship, or agency relationship.


11. Governing Law and Jurisdiction

These Terms are governed by English law and subject to the exclusive jurisdiction of the courts of England.


12. Notices

All notices must be made in writing. Buyers must notify TopRow promptly of any change of contact details.


13. Severability

If any provision is held unenforceable, the remaining provisions shall remain in full force and effect.


14. Survival

Provisions intended to survive termination shall remain in effect.


15. Amendments

These Terms may only be amended in writing and signed by an authorised TopRow representative.


16. Entire Agreement

These Terms constitute the entire agreement between Buyer and TopRow and supersede all prior agreements or understandings.
